Terms & Conditions

1. General

These Terms & Conditions govern your use of www.heavenartshop.com and any purchases made through it. By placing an order, you agree to these terms.

Heaven Art Shop is operated by Open Empower BV (KvK: 94970963), registered in the Netherlands.

2. Products & Pricing

• All artworks are original, one-of-a-kind pieces unless explicitly stated otherwise
• Prices are listed in Euros (EUR) and include VAT where applicable
• We reserve the right to update prices at any time; the price at time of purchase is final
• Product images are photographs of the actual artwork; slight color variations may occur due to screen settings
• Each artwork is accompanied by a Certificate of Authenticity

3. Orders & Payment

• Orders are confirmed once payment is successfully processed via Stripe
• We accept major credit/debit cards, Apple Pay, and Google Pay
• You will receive an order confirmation email with details and tracking information
• We reserve the right to cancel orders if fraud is suspected

4. Shipping

• We ship worldwide from Europe using insured, tracked delivery
• Shipping costs: Italy €15, Europe €25, Rest of World €35
• Estimated delivery: 5–14 business days depending on destination
• All artworks are professionally packaged with museum-grade, acid-free materials
• Customs duties and import taxes (if applicable) are the buyer's responsibility

5. Returns & Refunds

• You may return an artwork within 14 days of delivery
• The artwork must be in its original condition and packaging
• Contact info@heavenartshop.com to initiate a return
• Return shipping costs are the buyer's responsibility unless the item arrived damaged
• Refunds are processed within 7 business days of receiving the returned artwork
• If an artwork arrives damaged, contact us within 48 hours with photographs for a full refund or replacement

6. Intellectual Property

Purchasing an artwork grants you ownership of the physical piece. Copyright and reproduction rights remain with the artist. You may not reproduce, distribute, or commercially use images of the artwork without written permission from the artist or Heaven Art Shop.

7. Limitation of Liability

Heaven Art Shop is not liable for:

• Delays caused by shipping carriers or customs
• Color differences between the actual artwork and screen display
• Damage occurring after delivery due to improper handling or display

Our maximum liability for any claim is limited to the purchase price of the artwork.

8. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands, without prejudice to your statutory rights under EU consumer protection law.
